Terms of Use

1. Acceptance of Terms
By accessing or using Emerald Road (the "Platform"), you agree to be bound by these Terms of Use. If you do not agree, please do not use the Platform.
2. What We Are
Emerald Road is a marketplace that connects travelers with independent, third-party tour agencies and guides ("Agencies") operating in Azerbaijan. We do not own, operate, or directly provide any tours, transport, accommodation, or guiding services. Every tour listed on the Platform is created, priced, and fulfilled by the Agency that owns it. Emerald Road's role is limited to discovery, itinerary planning tools, and facilitating communication and bookings between travelers and Agencies.
3. Bookings and Payments
When you submit a booking through the Platform, you are entering into a direct arrangement with the Agency providing that tour. Pricing, currency, and payment methods are set by the Agency and displayed at the time of booking. Emerald Road may facilitate payment collection on behalf of an Agency, but is not a party to the underlying travel contract.
4. Cancellations and Refunds
Cancellation and refund terms are set individually by each Agency and are shown to you before you confirm a booking. Emerald Road will assist in relaying cancellation requests to the relevant Agency but is not responsible for an Agency's refund decision. We encourage travelers to review an Agency's cancellation policy carefully before booking.
5. Agency Responsibilities
Agencies listed on the Platform are independent businesses responsible for holding any required licenses, permits, and insurance for the services they offer, and for the accuracy of their own listings, pricing, and availability. Emerald Road performs reasonable onboarding checks but does not guarantee the conduct, safety record, or service quality of any Agency.
6. User Conduct
You agree to use the Platform lawfully and not to misrepresent your identity, submit fraudulent bookings, or interfere with the normal operation of the Platform or another user's access to it.
7. Limitation of Liability
To the fullest extent permitted by law, Emerald Road is not liable for any loss, injury, or damage arising from a tour, transport, or service provided by an Agency, including cancellations, delays, or service quality issues. Your use of any Agency's services is at your own risk and subject to that Agency's own terms.
8. Account Suspension
We may suspend or terminate access to the Platform for any user or Agency that violates these Terms, engages in fraudulent activity, or poses a risk to other users.
9. Governing Law
These Terms are governed by the laws of the Republic of Azerbaijan, without regard to conflict-of-law principles. [Placeholder — confirm final jurisdiction with legal counsel before publishing.]
10. Changes to These Terms
We may update these Terms from time to time. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
